Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court refused to accept the constitutional complaint for a decision, thereby rejecting the appellant's challenge to a municipal certification dated April 20, 2004, regarding investment grants. The dispute centered on the validity of a certification issued by a city under the Investment Subsidy Act 1999. The complaint was deemed inadmissible because the appellant failed to exhaust the administrative court system, a mandatory prerequisite for constitutional review under Section 6, Paragraph 1, Sentence 3, Alternative 2 of the Investment Subsidy Act 1999. Consequently, the municipal certification remains in force as the constitutional court did not examine the merits or modify the lower authority's decision.
