Constitutional complaint: rejection of counsel appointment and manifest inadmissibility due to lack of acceptance prerequisites
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (BVerfG) dismissed the constitutional complaint as manifestly inadmissible and rejected the applicant's request for the appointment of a legal assistant, rendering the pending request for interim relief moot. The dispute involved a challenge to a lower court decision, wherein the applicant sought both an ex parte appointment of a third party as legal counsel and a review of the merits. The court held that the application for legal aid under § 22 Abs. 1 Satz 4 BVerfGG was denied because the applicant failed to demonstrate that self-representation or representation by a statutory attorney was objectively necessary or subjectively mandatory, and the complaint itself was not admitted because it lacked the procedural prerequisites for admandation under § 93a Abs. 2 BVerfGG.
