Dispute over regulator's equity capital interest rates for network operators; scope of judicial review of administrative discretion and substantiation requirement for constitutional complaints
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (BVerfG) declined to accept the constitutional complaints for decision, leaving the contested judgments of the Federal Court of Justice in force. The complainants, electricity and gas network operators, challenged the Federal Court of Justice’s rejection of their appeal against the Federal Network Agency’s determination of equity capital interest rates for the third regulatory period, alleging a violation of their right to a lawful judge under Article 101(1) sentence 2 of the Basic Law and arguing that the lower court failed to refer the matter back for clarification regarding data distortions from including specific foreign markets. The Court held that the Federal Court of Justice properly distinguished between legal review of the regulator’s discretion and its own factual assessment, and that the complainants failed to substantiate the requirement that a different outcome in the underlying case was possible, thereby rendering the complaints inadmissible under Section 23(1) and Section 92 of the Federal Constitutional Court Act.
