Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court dismissed the applicant's request for an advance of costs (Auslagenerstattung), upholding the underlying order that declined to take up the constitutional complaint for decision. Following the dismissal of the complaint and the lapse of a pending application for interim relief, the applicant sought cost reimbursement pursuant to Section 34a in conjunction with Section 91a of the Code of Civil Procedure. The Court held that the applicant failed to demonstrate the special equitable grounds required by Section 34a Paragraph 3 of the Federal Constitutional Court Act for granting such an advance. The decision is final and non-appealable.
