Legislator-Zusammenfassung

KI-generiert

The German Federal Constitutional Court (Second Senate, First Chamber) ordered the repetition of a previously issued interim injunction, suspending the execution of a custodial sentence pending the final decision on the constitutional complaint, with a maximum duration of six months; the applicant prevailed in maintaining this suspension. The dispute concerned the enforcement of a custodial sentence imposed by the Essen District Court in 2017, subject to a prior appeal by the Federal Court of Justice, where the applicant challenged the continued execution of the sentence as a violation of fundamental rights. The Court applied § 32 Abs. 6 Satz 2 BVerfGG, determining that the statutory prerequisites for the initial interim relief remained valid, thereby justifying the extension of the stay of execution without requiring a new substantive assessment beyond the reasoning of the original December 2019 order.
