Recusal of chamber members and dismissal of constitutional complaint without substantive review
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the constitutional complaint without further reasoning, rendered the application for interim relief moot, and separately dismissed as inadmissible a request for recusal against the President, Vice-President, and a specific judge of the Court. The dispute concerned an attempt to challenge the participation of these officials in the proceedings, which the Court determined was procedurally defective because the challenged individuals did not belong to the specific chamber empowered to decide the matter. Applying § 93d Abs. 1 Satz 3 BVerfGG, the Court concluded that the complaint lacked sufficient prospects of success to warrant a detailed justification for its non-acceptance, thereby allowing the prior procedural status to remain in force.
