Repetition of interim suspension of custodial sentence execution during pending constitutional review
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (Second Senate, First Chamber) ordered the repetition of a temporary injunction for a sixth month, thereby maintaining the preliminary suspension of the execution of the applicant’s custodial sentence until a final decision on the constitutional complaint is rendered. The dispute concerned the enforceability of a custodial sentence imposed by the Essen Regional Court in 2017, which had previously been stayed by the Federal Court of Justice and then subject to constitutional review. The Court based its decision on § 32(6) Sentence 2 of the Rules of Procedure for the Federal Constitutional Court (BVerfGG), finding that the statutory prerequisites for the original injunction—originally issued in December 2019—remained fulfilled, thus allowing the continuation of the stay without requiring new substantive findings.
