Full cost reimbursement in constitutional complaint proceedings following mootness via state-level reversal
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court ordered the State of Saxony to fully reimburse the complainant's necessary costs, granting the applicant a substantive victory as the underlying constitutional complaint was deemed satisfied following the annulment of the challenged procedural order. The dispute arose from a constitutional complaint filed against a decision by a regional court's criminal chamber, which the Saxon Constitutional Court had partially accepted and quashed by lifting the objection against the initial dismissal of the applicant's parallel constitutional complaint at the state level. The decisive legal basis is § 34a(3) of the Federal Constitutional Court Act, under which full cost reimbursement is warranted when a constitutional complaint is rendered moot by the reversal of the contested measure at a lower constitutional level, provided the federal constitutional grievance would have likewise succeeded; the portion of the state complaint dismissed for inadmissibility was considered of subordinate significance and did not preclude the award.

BVerfGE 86, 90 ).
