Insolvency plan conditional validity and the requirement to substantiate legal interest for constitutional review
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court declined to accept the constitutional complaint, rendering the associated application for interim relief moot and thereby leaving the challenged decision in force. The dispute involved a constitutional challenge to an insolvency plan that had been concluded subject to a suspensive or resolutive condition; the complainants argued that this conditional structure violated their fundamental rights, seeking a declaration that the plan should no longer exert legal effect. The Court found that the applicants failed to meet the threshold requirements for ad under §§ 23 (1) sentence 2 and 92 of the Federal Constitutional Court Act by not substantiating why the insolvency plan continued to have legal effect for the purpose of establishing a need for legal protection, specifically failing to engage with the Federal Court of Justice’s established jurisprudence and scholarly literature confirming that insolvency plans may validly be linked to conditions within the meaning of § 158 (1) of the German Civil Code.

BGH, Beschluss vom 26. April 2018 - IX ZB 49/17 -, juris, Rn. 42; s.a. Eidenmüller, in: MüKoInsO, 4. Aufl. 2020, § 217 Rn. 44 m.w.N.).
