Renewal of provisional injunction suspending extradition to Romania for criminal prosecution
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court of Germany ordered the renewal of a provisional injunction for a further six months, upholding the previous suspension of the handover of a Romanian national to Romanian authorities for criminal prosecution, thereby granting the applicant's request to remain in Germany pending the final decision on the constitutional complaint. The dispute centered on the applicant's constitutional challenge to the German authorities' execution of an EU arrest warrant or extradition request, where the underlying factual basis for the initial injunction (issued in August 2018) remained applicable, necessitating continued protection against the imminent threat of surrender. The decisive legal basis is § 32(6) Sentence 2 of the Federal Constitutional Court Act (BVerfGG), which permits the repetition of a provisional order if the statutory prerequisites for its initial issuance—specifically the requirements for interim relief—continue to be met, while clarifying that the enforcement of the underlying custody remains unaffected by this procedural extension.
