Legislator-Zusammenfassung

The German Federal Constitutional Court (Second Senate, Second Chamber) extended its previous provisional order, suspending the surrender of the complainant to Romanian authorities for criminal prosecution for a period of up to six months, pending the final decision on the constitutional complaint. The case involves a constitutional complaint challenging the execution of an extradition or surrender order against a Romanian national, where the court had previously issued and repeatedly extended a stay of the surrender proceedings. The court reaffirmed the provisional stay, citing that the statutory preconditions for the initial order remained satisfied, and explicitly noted that the enforcement of the underlying detention for extradition purposes remains unaffected by this protective measure. The decision relies on § 32(6) sentence 2 of the Federal Constitutional Court Act (BVerfGG) regarding the repetition of provisional orders and established case law requiring that the conditions for the initial grant of interim relief must still persist for its extension.

[TENOR]

Die einstweilige Anordnung vom 24. August 2018, wiederholt mit Beschlüssen vom 1. Oktober 2018, vom 3. April 2019 und vom 26. [GRUENDE]
