Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court ordered a correction to the operative part (Tenor) of its prior non-acceptance decision dated January 29, 2018, effectively upholding the original non-acceptance of the constitutional complaint while fixing a drafting error. The dispute arose from a scrivener's error in the referenced provision, where "Satz 3" (Sentence 3) was erroneously cited instead of "Satz 4" (Sentence 4) on page 2, line 8 of the original order. Relying on the corresponding application of § 118(1) of the Code of Administrative Court Procedure (VwGO) and § 319(1) of the Code of Civil Procedure (ZPO), the Court authorized the correction after hearing the complainant, with the amended decision being final and unappealable.
