Suspension of extradition to Romania under § 32 Abs. 5 BVerfGG pending constitutional complaint review
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court, Second Senate, issued an interim order suspending the surrender of the applicant to Romania for a period of up to six weeks, pending the decision on the announced constitutional complaint, while explicitly leaving the existing custody for extradition unaffected. This proceeding involved a request for provisional relief against the imminent handover of the applicant to Romanian authorities, requiring the submission of a valid power of attorney within the specified timeframe to maintain the suspension. The decisive legal basis for the order was § 32 Abs. 5 S 1 BVerfGG, under which the decision was announced without detailed grounds at the initial stage, with a reasoned judgment to be appended subsequently.
