Unconstitutional refusal to prosecute criminal offenses: non-admissibility of constitutional complaint lacking concrete public authority act
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court refused to accept the constitutional complaint for decision, ruling it inadmissible and thereby dismissing the associated request for interim relief. The dispute concerned a challenge to alleged refusals of criminal prosecution by the Federal Court of Justice, but the complaint failed to designate a valid subject of complaint as it did not constitute a concrete exercise of public authority. The decision rested on the finding that the applicant’s brief was manifestly insufficient under procedural requirements, specifically failing to substantively articulate a constitutional rights violation and failing to submit or reproduce the essential content of the relevant administrative decision within the statutory deadline.
