Inadmissibility of constitutional complaint against social court emergency order for failure to substantiate unreasonableness of deferral to main proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court did not admit the constitutional complaint for decision, rendering the accompanying request for interim relief moot; the applicant failed to prevail in having the challenged social court emergency decisions set aside or reviewed. The dispute concerned a constitutional complaint against emergency orders by the social courts regarding the reduction of benefits under the Asylum Seekers' Benefits Act, specifically challenging whether the constitutional rights violations alleged could not be remedied in the main proceedings. The decisive legal basis for the rejection was the failure to meet the admissibility requirements of § 23 (1) sentence 2 and § 92 BVerfGG, as the applicant did not provide a substantiated argument that referring the matter to the main proceedings was unreasonable, particularly given that the challenged benefit reduction appeared to have already ceased at the time the complaint was filed.
