Extradition of national to home state: Constitutional prohibition of deportation to country of origin pending review
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court’s Second Chamber, acting as the Second Panel, renewed its interim measure suspending the extradition of a Romanian national to Romania for criminal prosecution for a period of up to six months, allowing the complainant to prevail in maintaining this protective order pending the final decision on the constitutional complaint. The dispute concerned the enforcement of an extradition arrest, with the Court previously issuing the initial interim order in August 2018 and renewing it in October 2018 and April 2019; this decision confirms that the prerequisites for the interim suspension remain satisfied, while explicitly clarifying that the execution of the underlying extradition detention remains unaffected by the suspension of the handover. The legal basis for the renewal relies on the doctrine that an interim order can be repeated if the statutory conditions for its initial issuance continue to exist, as grounded in the Federal Constitutional Court Act (BVerfGG) § 32(6) sentence 2.
