Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court rejected the complainant's application for reimbursement of necessary expenses and denied legal aid, effectively leaving the unmerited constitutional complaint and the underlying administrative litigation proceedings unaffected. The dispute arose when a complainant filed a constitutional complaint against a lower court's handling of a hearing objection (Anhörungsrüge) before the administrative court had issued a decision on that objection. The court held the complaint inadmissible because the statutory exhaustion of legal remedies had not been met under § 90(2) Sentence 1 of the Federal Constitutional Court Act (BVerfGG), as the complainant failed to demonstrate that a serious and unavoidable disadvantage would have resulted had the legal path been exhausted first. Consequently, the denial of legal aid was justified under § 114(1) of the Code of Civil Procedure (ZPO), which requires an expectation of success for such grants.

Ablehnung der Auslagenerstattung im Verfassungsbeschwerdeverfahren: Unzulässigkeit der Verfassungsbeschwerde bei Beschwerdeerhebung vor fachgerichtlicher Entscheidung über Anhörungsrüge - Tenorbegründung

[TENOR]
