Extradition-related interim relief denied for insufficient substantiation of disproportionate interference with Article 6(1) Basic Law family rights
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court (Second Senate, Second Chamber) rejected the application for interim relief, ruling that the applicant had failed to substantiate that their pending constitutional complaint was not inadmissible or manifestly unfounded. The case involved a challenge to an extradition matter, where the applicant argued that holding a non-German national criminally liable outside the national territory violated their right to family life. The court held that Article 6(1) of the Basic Law generally does not protect against such extraterritorial criminal liability, and the applicant had not sufficiently demonstrated any disproportionate interference with this fundamental right based on the specific circumstances of the individual case in either the ordinary jurisdictional proceedings or the constitutional court procedure.
