Constitutional complaint against appellate court decision: Inadmissibility due to insufficient demonstration of direct fundamental rights violation
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court refused to accept the constitutional complaint for decision, thereby rendering the applicant's motion for interim relief moot. The applicant challenged a final decision by a Regional Court of Appeals, asserting a violation of her own fundamental rights. The court declared the complaint inadmissible under Section 93a(2) of the Federal Constitutional Court Act because the application failed to demonstrate a sufficient causal link establishing that the applicant was directly affected in her own fundamental or fundamental-equivalent rights by the lower court's ruling, and it cited the failure to submit numerous essential documents referenced by the lower court.
