Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court refused to accept the constitutional complaint for decision, thereby upholding the lower courts' rulings that denied compensation to the complainants. The dispute concerned the refusal of compensation under Sections 2 and 3 of the Structural Change Act (StrEG) to the owners of a limited liability company that became insolvent as a result of seizure orders. The Court found no constitutional violation, noting that any damage to property rights protected by Article 14(1) of the Basic Law could be pursued through other legal avenues, specifically citing state liability claims under Section 839 of the German Civil Code in conjunction with Article 34 of the Basic Law.
