The Federal Constitutional Court declined to accept the constitutional complaint for decision and deemed the request for interim relief moot, leaving the lower court's decision intact. The dispute involved a challenge to a domestic appellate court’s refusal to address specific constitutional complaints, specifically alleging a violation of the prohibition on double jeopardy and a breach of the right to a fair trial regarding potential future criminal enforcement proceedings in a target state. The court ordered the rejection based on procedural inadmissability under § 23(1) sentence 2 and § 92 of the Federal Constitutional Court Act (BVerfGG), finding that the complainant failed to meet the mandatory requirements for sufficient reasoning, particularly by failing to engage substantively with the lower court's reasoning on double jeopardy and failing to demonstrate even a prima facie case for the alleged violation of fair trial principles.

Nichtannahmebeschluss mit Tenorbegründung: Unzulässigkeit der Verfassungsbeschwerde wegen unzureichender Begründung

[TENOR]

§ 40 Abs. 3 GOBVerfG).
