Legislator-Zusammenfassung

The Federal Constitutional Court refused to accept the constitutional complaint for adjudication, rendering the incidental motion for interim relief moot. The dispute concerned a constitutional challenge to an Oberlandesgericht decision of November 19, 2018, which had ruled on a "Hearing Complaint" (Anhörungsrüge) lodged by the complainant, despite the initial petition not explicitly using that terminology. The Court held the complaint inadmissible under Section 93a(2) of the Federal Constitutional Court Act (BVerfGG), finding it failed to meet the mandatory requirements of Section 23(1) sentence 2 and Section 92 BVerfGG because the reasoning did not allow for a comprehensible identification of a fundamental rights violation under Section 90(1) BVerfGG; the Court determined that the lower court had adequately addressed both the alleged violation of the right to be heard and the complaint of a lack of a competent court, making the complainant's argument that the complaint was not properly decided untenable.

Nichtannahme einer mangels nachvollziehbarer Begründung unzulässigen Verfassungsbeschwerde

[TENOR]
