The Federal Constitutional Court issued an interim order compelling that Sections 6a(1) No. 2 and 3 and 6a(2) No. 1 in conjunction with 6a(1) No. 2 and 3 of the European Parliament Elections Act not be applied during the 2019 European Parliament elections, thereby prevailing in the challenge by applicants against the legislative provisions. The dispute concerned the eligibility of voters, specifically targeting the statutory disenfranchisement of individuals under full guardianship (Betreute in allen Angelegenheiten) and convicted offenders subjected to custodial commitment on grounds of irresponsibility (Schuldunfähigkeit), which the court ordered must be suspended for the entry into, and objections against, the voter rolls. The decisive legal basis was the court's power to issue interim measures to protect fundamental rights, specifically the constitutional right to participate in free and equal elections (Article 38(1) in conjunction with Article 38(1) of the German Basic Law and the European Parliament Elections Act), requiring the immediate non-application of the restrictive voting exclusion statutes to ensure the procedural integrity of the upcoming election.
