Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court refused to accept the constitutional complaint for a decision, thereby dismissing the applicant's challenge and leaving the lower court rulings in force. The dispute concerned the admissibility of a constitutional complaint in a non-published proceedings context where the applicant alleged rights violations but failed to submit the unpublished decisions of the higher regional court and relevant party submissions from the specialized court proceedings that formed the basis of the challenged acts. Relying on the substantiation requirements of §§ 23 Abs. 1 Satz 2 and 92 of the Federal Constitutional Court Act, the Court held the complaint inadmissible because the petitioner did not provide the essential documentary evidence needed for the court to conduct a review without further research, and it dispensed with a further detailed explanation pursuant to § 93d Abs. 1 Satz 3 of the same Act.
