Denial of legal aid for constitutional complaint due to failure to submit financial declaration before case resolution
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (1st Senate, 1st Chamber) rejected the applicant's petition for legal aid and the assignment of a counsel, ruling that the request was not mature for approval at the time the underlying constitutional complaint was rendered moot. The dispute concerned the procedural admissibility of a legal aid application where the mandatory declaration of personal and financial circumstances under § 117 Abs. 2–4 ZPO was either not submitted or received only after the resolution of the main proceedings. Deciding that while a previously mature application survives the extinction of the case, legal aid cannot be granted if the financial disclosure is filed post-emptively or not at all, the court denied the request based on § 114 ZPO and § 117 Abs. 2–4 ZPO, noting the decision is final and unchallengeable.

BVerfG, Beschluss vom 27. Oktober 2017 - 1 BvR 1746/16 -, juris, Rn. 3).
