Legislator-Zusammenfassung

The German Federal Constitutional Court granted the constitutional complaint, finding that the lower labor court decisions violated the complainant’s fundamental rights under Article 2(1) in conjunction with Article 20(3) of the Basic Law; the Court ordered the reversal of the Landesarbeitsgericht Nürnberg judgment and remanded the case for retrial, thereby rendering the prior Bundesarbeitsgericht leave-to-appeal order moot, and awarded necessary litigation costs to the complainant. The dispute concerned the interpretation of § 14(2) sentence 2 TzBfG (Part-Time and Fixed-Term Employment Act) regarding the validity of fixed-term contracts, where the complainant challenged the application of established labor court case law that she argued exceeded the bounds of permissible legal construction. The decisive legal basis was the Constitutional Court's determination that the specific judicial doctrine applied by the labor courts constituted an impermissible deviation from statutory interpretation and judicial law-making, rendering the challenged judgments unconstitutional.

[GRUENDE]
