Legislator-Zusammenfassung

KI-generiert

In a Constitutional Court chamber decision, the respondent state prevailed by having its necessary litigation costs refunded, while the complainant succeeded in having the lower court judgments annulled and the case remanded. The dispute concerned the interpretation of § 14(2) sentence 2 TzBfG regarding the termination of fixed-term employment contracts, where the complainant challenged labor court decisions that were based on existing Federal Labor Court case law. The Constitutional Court held that the challenged decisions violated the complainant's fundamental rights under Article 2(1) in conjunction with Article 20(3) of the Basic Law, determining that the underlying Federal Labor Court jurisprudence exceeded the limits of acceptable interpretation and permissible judicial law development, rendering the specific appellate judgment void and the Federal Labor Court's stay of proceedings moot.

[GRUENDE]
