Part-time employment contract interpretation: Exceedance of permissible judicial lawmaking under § 14(2) TzBfG violating the right to a legally bound judge
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (First Senate, Second Chamber) upheld the constitutional complaint, finding that the petitioner’s fundamental rights under Article 2(1) in conjunction with Article 20(3) of the German Basic Law were violated; consequently, the court set aside the decision of the Lower Labor Court of Nuremberg, remanded the case to that court for re-examination, and ordered the Federal State of Bavaria to reimburse the petitioner’s necessary expenses. The dispute concerned a labor law case where the lower courts had applied the Federal Labor Court’s established jurisprudence interpreting Section 14(2) sentence 2 of the Part-Time and Fixed-Term Work Act (TzBfG), which the Constitutional Court found to exceed the limits of tolerable interpretation and permissible judicial lawmaking. This ruling renders the prior Federal Labor Court decision on the non-acceptance of the appeal moot, based on the precedent that such statutory interpretation violates the constitutional right to a legally bound judge.
