Excessive interpretation of § 14(2) TzBfG in fixed-term employment contracts violating fundamental rights
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court quashed the decisions of the Labor Court of Appeal Nuremberg and the Labor Court of Bamberg, remanded the case to the appellate level, and ordered the State of Bavaria to reimburse the complainant's necessary costs, thereby finding in favor of the complainant. The dispute concerned a constitutional complaint against labor court judgments that relied on Federal Labor Court case law interpreting Section 14(2) sentence 2 of the Part-time and Fixed-Term Employment Act (TzBfG). The Court held that the challenged decisions violated the complainant's fundamental rights under Article 2(1) in conjunction with Article 20(3) of the German Basic Law because the underlying Federal Labor Court jurisprudence on the interpretation of the Act exceeded the limits of permissible interpretation and judicial law development, as previously established by the First Senate in 2018.

April 2011 - 7 AZR 716/09 -, BAGE 137, 275 ; Urteil vom 21. September 2011 - 7 AZR 375/10 -, BAGE 139, 213 ). Nach dem Beschluss des Ersten Senats des Bundesverfassungsgerichts vom 6.
