Judicial reinterpretation of TzBfG fixed-term limits exceeds constitutional bounds of judicial law-making
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (BVerfG) accepted the constitutional complaint, finding that the contested decisions of the Lower Labor Court of Bamberg and the Labor Court of Appeal of Nürnberg violated the complainant's fundamental rights under Articles 2(1) and 20(3) of the Basic Law. The Court held that the prior judgments relied on case law from the Federal Labor Court (BAG) interpreting § 14(2) Sentence 2 of the Part-Time and Fixed-Term Employment Act (TzBfG), which, following the BVerfG's earlier decision of June 6, 2018 (1 BvL 7/14, 1 BvR 1375/14), exceeded the limits of permissible judicial interpretation and judicial law-making. Consequently, the BVerfG overturned the Labor Court of Appeal's judgment, remanded the case for further review, and declared the corresponding Federal Labor Court non-appealable order void, while ordering the state to reimburse the complainant's necessary legal expenses.
