Deportation suspended after administrative court cited unserved deportation order in violation of effective legal protection guarantee
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court issued an interim order prohibiting the respondent's deportation to Turkey for a period of three months, granting relief to the applicant and ordering the state of Lower Saxony to reimburse litigation costs. The dispute concerned a challenge against an administrative court decision that granted interim legal protection while referring to a Federal Office for Migration and Refugees deportation order that had not yet been served on the applicant at the time of the judicial ruling. The Court determined that the administrative court violated the right to effective legal protection under Article 19(4) of the Basic Law by deciding on the basis of a document to which the applicant had no opportunity to respond, and that the balancing of consequences favored the applicant, leading to the suspension of the deportation.
