Unidentified recusal motion and unadorned constitutional complaint rejected for manifest procedural defects
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the constitutional complaint as inadmissible and rejected the accompanying motion for recusal of judges as manifestly inadmissible, resulting in no change to the status of the underlying proceedings. The dispute concerned a procedural challenge where the applicant filed a motion to recuse unspecified judges and a constitutional complaint without providing a substantive legal argumentation. The decisive legal basis for the recusal rejection was the failure to expressly name the specific individual judges subject to the recusal or to provide a basis for their identification, rendering the motion manifestly inadmissible under Article 19 of the Federal Constitutional Court Act (BVerfGG), which allows the Court to decide such manifestly inadmissible motions without the involvement of the targeted judges. The constitutional complaint itself was rejected without further reasoning pursuant to Article 93d(1) Sentence 3 BVerfGG due to its inadmissibility, and the associated application for interim relief became moot.

Nichtannahme einer Verfassungsbeschwerde ohne weitere Begründung (§ 93d Abs 1 S 3 BVerfGG) - Verwerfung eines mangels Benennung bzw anderweitiger Bestimmbarkeit der abgelehnten Richter offensichtlich unzulässigen Ablehnungsgesuchs (§ 19 BVerfGG)
[TENOR]
1. Das Ablehnungsgesuch wird als unzulässig verworfen.
2. Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.
4. Diese Entscheidung ist unanfechtbar.
