Legislator-Zusammenfassung

The Federal Constitutional Court ordered the respondent state to reimburse one-third of the complainants' necessary attorney fees and fixed the matter's value for procedural costs at €1,000,000 per case. This decision addresses ancillary cost allocations in constitutional complaint proceedings, following a substantive ruling where the complaints were partially dismissed and partially rejected. The Court applied Section 34a(3) of the Federal Constitutional Court Act, determining that a partial refund was equitable because the proceedings, despite their mixed outcome, contributed to clarifying issues of fundamental legal significance, while Sections 37(2) and 22(1) of the Lawyers' Fees Act governed the valuation of the legal matter.

Anordnung der teilweisen Auslagenerstattung im Verfassungsbeschwerdeverfahren (§ 34a Abs 3 BVerfGG) sowie Gegenstandswertfestsetzung

[TENOR]
