Eligibility of municipal umbrella association employees as lay judges in social assistance: employment does not establish exclusion under § 17 Abs. 3 SGG or bias
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (1st Senate, 2nd Chamber) declined to accept the constitutional complaint for decision, leaving the challenged Federal Social Court ruling in force. The dispute concerned the eligibility of employees of municipal umbrella associations to serve as lay judges in social assistance cases, specifically whether their employment relationship constituted grounds for exclusion under § 17(3) SGG or raised concerns of bias under general bias doctrines. The Court determined that the prerequisites for admissibility under § 93a(2) BVerfGG were not met, as it found no compelling constitutional objections to the view that such employment alone does not automatically render lay judges excluded or biased in social assistance matters.
