Partial cost reimbursement and subject matter value assessment in constitutional complaint proceedings under § 34a BVerfGG and §§ 37, 22 RVG
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court ordered the Federal Republic of Germany to reimburse one-third of the complainants' necessary legal expenses and set the subject matter value for attorney services at €1,000,000 for the main proceedings and €500,000 for interim measures. This decision addressed the procedural consequences of prior rulings that had partially dismissed and partially rejected the constitutional complaints, determining whether the complainants were entitled to cost reimbursement despite their partial lack of success. The Court held that although the complaints did not fully prevail, they contributed to the clarification of questions of fundamental importance, thereby justifying an ex aequo et bono reimbursement of one-third of the costs pursuant to § 34a(3) of the Federal Constitutional Court Act (BVerfGG), with the subject matter values fixed according to §§ 37(2) and 22(1) of the Legal Services Fee Act (RVG).
