Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court rejected the constitutional complaint and dismissed the accompanying request for judicial recusal as inadmissible, leaving the challenged provision in force. The dispute involved a challenge to the criminal prohibition of business-like facilitation of suicide under § 217 of the German Criminal Code, with the applicant seeking to have a specific judge recused from the proceedings. The Court ruled that the complaint did not meet the admissibility requirements of § 93a para. 2 of the Federal Constitutional Court Act because the applicant lacked both an immediate and current personal grievance (*unmittelbare und gegenwärtige Beschwerde*), as the abstract legal provision had not yet resulted in a concrete, direct violation of the applicant's fundamental rights.
