Balancing freedom of expression against personal honor in labor dispute: no constitutional infringement despite missing lower court balancing
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to accept the constitutional complaint for decision, thereby allowing the lower court's judgment to stand, and fixed the value of the matter at €5,000. The dispute involved a complaint challenging a labor court decision that categorized the complainant's statements as formal insults and scathing criticism, which restricted her freedom of expression. Although the Court acknowledged that the lower court failed to sufficiently justify its finding and neglected the constitutionally required balancing of the complainant's freedom of expression against the personal honor and economic freedom of the affected party, it held that acceptance was not warranted because it was clear that the required balancing would have resulted in the rights of the opposing party prevailing under the specific circumstances. The decision relied on § 93a(2) of the Rules of Procedure of the Federal Constitutional Court (BVerfGG) regarding the lack of a particularly severe disadvantage, and § 37(2) sentence 2 in conjunction with § 14(1) of the Court Costs and Fees Act (RVG) for the fee determination.
