Admissibility of suspension of a fully executed prison transfer under § 114(2) StVollzG and effective legal protection
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to hear the constitutional complaint and denied legal aid, leaving the underlying procedural status quo unchanged, although it implicitly acknowledged that the applicant’s fundamental right to effective legal protection under Article 19(4) of the German Basic Law was violated by the lower court’s dismissal of an interim relief request. The dispute concerned a prisoner’s challenge to the enforcement of a prison transfer, specifically whether the request to suspend the execution of that measure under Section 114(2) Sentence 1 of the German Penal Execution Act remained admissible after the transfer had already been carried out. While the Court affirmed that such suspension requests are not excluded from the scope of the provision merely because the measure is already in execution, it held that the constitutional grievance was mooted by "procedural preemption," as the same regional court had subsequently granted the applicant’s main action by annulling the transfer decision, rendering the initial restrictive interim order irrelevant and leaving no room for a favorable constitutional ruling.
