Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court of Germany rejected the applicant's request for interim relief to suspend deportation, thereby dismissing the constitutional complaint. The dispute concerned the enforceability of a deportation order following the rejection of an asylum claim and a subsequent unsuccessful asylum follow-up application. The Court held that the applicant failed to demonstrate the likelihood of success in the main proceedings, specifically by not showing that the statutory three-month deadline under § 51(3) of the Administrative Procedure Act for filing a follow-up application was met, and by failing to submit the initial rejection notice or the administrative court judgment to substantiate any claimed change in circumstances.

§ 51 Absatz 3 Verwaltungsverfahrensgesetz

The court determined the inadmissibility of the constitutional complaint because the dispositive explicitly states it is not evident whether the three-month deadline under this provision for filing an asylum follow-up application was fulfilled.
