Legislator-Zusammenfassung

The Federal Constitutional Court declined to accept the constitutional complaint for decision, thereby leaving the lower court's judgment in force, while explicitly referencing a prior chamber decision from May 23, 2016. The dispute concerned the validity of a "split interpretation" applied by the Federal Court of Justice to § 8 of the former German Insurance Contract Act (VVG a.F.), specifically whether the teleological reduction of § 8(5) sentence 4 VVG a.F. regarding the surrender rights in life insurance contracts exceeded the limits of judicial law-making. The Court held that this interpretive method was constitutionally permissible because § 8(5) VVG a.F. is legally intertwined with § 8(4) VVG a.F. as part of a unified regulatory complex governing time limits for contract termination across all insurance types, thus respecting the boundaries of judicial legal development under the doctrine of *Richterliche Rechtsfortbildung*.
