Renewal of interim suspension of census register provision due to continued risk of significant harm and reasonable prospect of success on the merits
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court ordered the renewal of its prior interim order, suspending the enforcement of § 19 of the 2011 Census Act for an additional six months or until the final judgment on the merits in the abstract norm control proceedings, thereby prevailing over the legislative challenge to the statute. The dispute concerned the abstract norm control review of § 19 ZensusG 2011, which regulates the register-based census methodology, where the applicant had previously succeeded in securing a temporary suspension of the provision's application. The decision relied on § 32 Abs. 6 Satz 2 BVerfGG, which permits the repetition of an interim order only if the statutory prerequisites for its initial issuance remain satisfied, specifically the risk of significant harm from immediate enforcement and a reasonable prospect of success on the merits, standards the Court found continued to be met.
