Withdrawal of deportation orders to Italy and constitutional requirements for specific assurances of accommodation for families with minors
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court ordered the dismissal of the constitutional complaint as moot due to the respondents' withdrawal of the challenged deportation orders, ruling that the applicants prevailed in obtaining a refund of necessary costs and setting the subject matter value at €10,000. The dispute arose from the applicants’ challenge to deportation orders to Italy, specifically contesting the adequacy of protection for families with toddlers upon arrival. The Court relied on established constitutional and Convention rights jurisprudence, requiring that a concrete, case-specific assurance from receiving authorities be obtained prior to transfer, ensuring the family would receive secured accommodation; because Italy could not provide such assurances at the time, the underlying deportation measures were rendered ineffective, necessitating the procedural closure and cost reimbursement under § 34a Abs. 3 BVerfGG.
