Prisoner’s right to effective access to court: inadmissibility of constitutional complaint for lack of hearing complaint where delay in transmission of filing is claimed
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the constitutional complaint as inadmissible, leaving the lower court's decision in force, as the applicant failed to file a prior hearing complaint (Anhörungsrüge). The dispute involved a prisoner's claim that the high court violated their right to effective legal remedy under Article 103(1) of the Basic Law by failing to expedite their filings, rather than constituting a secondary hearing complaint regarding procedural violations. The Court ruled that the specific allegation constituted an independent constitutional breach not covered by the statutory prerequisite for a hearing complaint, while noting in an obiter dictum that detention facilities may be obligated to transmit prisoner requests to courts rapidly (e.g., via fax) to ensure timely access to justice under Article 19(4) of the Basic Law.
