Valuation of subject matter for attorney fees in constitutional complaint proceedings

The Federal Constitutional Court set the value of the subject matter for legal fees at €60,000 for each of the two consolidated constitutional complaints. The proceedings concerned the procedural issue of determining the "Gegenstandswert" (value of the matter) in the context of a constitutional complaint against an administrative court decision, where the court had to assess the intensity of the constitutional impact to calculate attorney fees under the German Courts Constitution Act. The court applied Section 37(2) in conjunction with Section 14(1) of the Law on Fees for Attorneys (RVG) to establish the fee base, relying on its established jurisprudence (BVerfGE 79, 365) which links the valuation to the significance of the constitutional rights violated or asserted.
