Suspension of census data retention provision pending norm control decision
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (Second Senate) ordered the repetition of a provisional injunction for an additional six months, suspending § 19 of the Census Act 2011 until a decision on the merits is rendered or the six-month period expires, thereby effectively upholding the previous order that kept the contested provision out of effect. This proceeding was a repetition application within an abstract norm control case, where the petitioner sought to extend the interim protection against the application of the data protection provisions of the census legislation previously suspended on August 26, 2015. The Court determined that the repetition was justified because the statutory prerequisites for the initial issuance of a provisional injunction, specifically under § 32 Abs. 6 Satz 2 BVerfGG, remained satisfied, relying on the legal reasoning established in the earlier decision from August 2015.
