Standing and exhaustion of remedies for search of tax advisor’s premises under constitutional property and hearing rights
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court issued a non-acceptance order, rendering the constitutional complaint inadmissible and leaving the lower court orders in force, while the applicant's request for provisional measures became moot. The dispute concerned a search of the applicant's premises and the offices of his tax advisor, where the applicant challenged the specificity of the underlying criminal suspicion and the continued seizure of numerous computers and data carriers. The Court determined that the applicant lacked standing under Article 13 of the Basic Law regarding the search of the advisor's premises and failed to exhaust legal remedies by not filing a hearing objection regarding alleged violations of Article 103(1) of the Basic Law, thereby rendering it unnecessary to decide on the proportionality of the data seizure under § 110 Code of Criminal Procedure.
