Constitutional complaint inadmissible for failure to file a hearing objection regarding legal aid documentation
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court declined to admit the constitutional complaint, upholding the lower instance proceedings and finding the applicant's challenge inadmissible. The dispute concerned the rejection of an application for legal aid in social security proceedings, where the Social Court denied the request on the basis that the documentation submitted by the applicant failed to cover the required time period, despite the applicant's claim of full compliance with the submission order. The Court held that the complaint violated the principle of subsidiarity under § 93a (2) BVerfGG because the applicant failed to exhaust the remedial option of filing an objection to non-hearing (*Anhörungsrüge*) pursuant to § 178a SGG, which would have allowed the Social Court to address the alleged procedural error and omission of a necessary hint regarding the document requirements.
