Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court granted the constitutional complainant's request, ordering the repetition of a temporary injunction for an additional six months, effectively continuing the provisional ban on the surrender of a U.S. citizen to Italy. This procedural decision arose from a constitutional complaint challenging the planned extradition of the individual, a matter previously subject to a preliminary injunction issued by the Second Senate in November 2014 and extended in May 2015. The Court based its ruling on Section 32(6) sentence 2 of the Federal Constitutional Court Act (BVerfGG), determining that the statutory prerequisites for the initial issuance of a temporary injunction—requiring a prima facie showing of a fundamental rights violation and urgency—remained satisfied, thereby maintaining the status quo pending the final decision on the merits of the constitutional complaint.
