Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court dismissed the constitutional complaint as inadmissible, denying the complainant relief. The dispute concerned the procedural validity of a constitutional complaint filed against a labor court decision, where the complainant failed to exhaust legal remedies and provided insufficient argumentation. The Court held that the complaint was time-barred under § 93 Abs. 1 BVerfGG because the withdrawal of an initially filed but legally improper remedy did not toll the one-month filing deadline; it further found the legal route not exhausted under § 90 Abs. 2 BVerfGG due to the failure to file a hearing complaint (§ 78a ArbGG); and it determined the submission failed to meet the substantiation requirements of §§ 23 Abs. 1 Satz 2, 92 BVerfGG, thereby rendering the complaint inadmissible.

Nichtannahmebeschluss: Mangels Fristwahrung, Rechtswegerschöpfung und hinreichender Begründung unzulässige Verfassungsbeschwerde - unstatthaftes Rechtsmittel hält Monatsfrist des § 93 Abs 1 S 1 BVerfGG nicht offen

[GRUENDE]
