Constitutional complaint rejected for failure to exhaust social court interim relief before challenging reduction of livelihood benefits for duty violations.
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court rejected the constitutional complaint for inadmissibility, leaving the lower court proceedings unresolved and requiring the complainant to exhaust specific procedural remedies first. The dispute concerned the reduction of benefits for the maintenance of livelihood due to duty violations under social welfare law, where the complainant alleged a violation of fundamental rights without first utilizing available specialized legal avenues. Relying on the doctrine of subsidiarity, the Court held that the complaint failed to meet the requirement of exhausting all procedural options, specifically ordering the complainant to seek interim relief in the specialized social court proceedings under Section 86b of the Social Court Act (SGG).

Nichtannahmebeschluss: Subsidiarität der Verfassungsbeschwerde gegenüber der Inanspruchnahme fachgerichtlichen Eilrechtsschutzes - hier: Rechtsschutz gem § 86b SGG bzgl Minderung von Leistungen zur Sicherung des Lebensunterhalts wegen Pflichtverletzung (§§ 31ff SGB II )
[GRUENDE]
